Sri Lanka UN Panel Report: Rajapaksa Cornered But Defiant – Analysis

Since day one the Rajapaksa regime has successfully manipulated the whole UN establishment including its Secretary General Ban Ki-moon, his chief of staff Nambiar and the UN Human Rights Council, and has in the process not only made a mockery of the UN system but made Ban him self look weak and not in control.

The regime has used every tactic in the book before, during and after its brutal war with the LTTE to cleverly out-maneuver the UN and twist Ban round its fingers. All this at a high cost amounting to colossal loss of lives; untold human suffering; obstruction of justice including distortion of the truth. The UN Panel of Expert’s Report has turned out to be an expose of the Rajapaksa regime’s conduct of the war and the aftermath. Although cornered, the Rajapaksa regime is defiant; while denouncing the report and in a last ditch effort to prevent the publication of the report is engaging in political and diplomatic maneuvers in a multi-pronged attack against the Panel’s findings. The regime described the report, according to AFP, as “fundamentally flawed and patently biased,” and adding that it was “presented without any verification”.

Also hitting hard at the UN and its organs and bodies, the Panel lay blame on the UN for not protecting lives.

There was indeed a manipulation of the United Nations system by the actions of the Rajapaksa Regime and a few individuals and nations, fraught with lies, intrigues and cover-ups which led to the failure of the system to protect lives and enabling however the passage of a “deeply flawed” motion, put forward by the Rajapaksa regime in May 2009 soon after the war at a special session of the Human Rights Council, prompting the Panel to call for both a reconsideration of this resolution believing it was “acted on the basis of incomplete information” and a “comprehensive review of the humanitarian and protection mandates” of the United Nations.

But in direct contrast G L Peiris, Sri Lankan External Affairs Minster resisting publication of the report said the release of the full report would actually damage the UN system.

Jeeva Skandamoorthy in an article titled ‘Sri Lanka Tamil Genocide and the Failure of the UNand International Community to Protect’ alludes to Ban’s low-key rhetoric and implicit support of GoSL’s conduct of the war, the TIMES revelation that Ban was told in advance that at least 20,000 Tamil civilians were killed in the Sri Lankan Government’s final offensive against the Tamil Tiger rebels: “Mr. Ban never mentioned the death toll during his tour of the battleground on 23rd May 2009,” and “never mentioned this figure to his Sri Lankan interlocutors” (Gulf Daily News, 7th June 2009).

Skandamoorthy also refers to Prof. Boyle’s criticism of Ban for not appointing a commission of inquiry: “UN Secretary General has an obligation to act to prevent criminal activity and either refuses to or fails to do so, that would render him ‘complicit’ with the underlying criminal activity- in this case genocide – article 111(e) of the 1948 Genocide Convention which prohibits, criminalises and calls for the punishment of those ‘complicit in genocide’.”

In addition he cites the revelation by “THE TIMES, relating to Vijay Nambiar, chief of staff to Ban, in his role as a UN envoy and his dealings with GoSL which was called into question since his brother Satish has been a paid consultant to the Sri Lankan army since 2002 and was a close supporter of General Sarath Fonseka (Commander of SLA forces).

Jeeva also cites TamilNet which on 30, May 2009 carried an item from the French paper Le Monde, which quoted Vijay Nambiar as telling UN representatives that the “UN should keep a low profile” and play a “sustaining role” that was compatible with the (Rajapaksa) government”. He refers to Prof. Boyle’s comments about the complicity of both the UN and its officials in aiding the Rajapaksa regime: “In other words both the United Nations organizations and its highest level officials are guilty of aiding and abetting Nazi-type crimes by the GoSL against Tamils.”

Skandamoorthy recalls certain anecdotes which clearly reveal Sri Lanka’s strategy to get the member nations on board for its war of attrition against the oppressed Tamil population by depicting it as a ‘war on terror’ and preventing the application of the principles embodied in R2P – Responsibility to Protect: On UN failure with R2P in Sri Lanka, Norman Chomsky, Professor Emeritus of linguistics at MIT said at the UN General Assembly the “hypocrisy was so profound, it was suffocating.”

The International Crisis Group said in its report dated 11, January 2010. “India and Western governments may yet come to regret giving Sri Lanka the green light and even assisting it to fight a ‘war on terror’.”

As the world waited on Thursday 21, April to finally see the official version of the UN Panel’s report in full, what it got was a late briefing from Ban’s, Deputy Spokesman Farhan Haq telling the media that the Sri Lankan government “is being given another chance to respond.” This was contrary to Haq’s position just the previous day that the Rajapaksa regime’s lack of response, “doesn’t need to tie our hands down regarding when we are going to put out this report. As we have said repeatedly, we’ll put it out this week.”

The Executive Summary of the Panel’s report and parts of the main document were mysteriously leaked after it was delivered to the government to look at first. Kusala Perera journalist explains: Ban Ki-moon’s Independent Advisory Panel of Experts on Sri Lanka, that is not based on any UN resolution and is not binding on UN to follow up on, is being hyped and carried as an official investigation by the UN, to give MR the space to go on a blitzkrieg that would once again have the Sinhala majority running behind Rajapaksa patriotism. For this, there was a necessity to have some “leak” to work on, make statements and start a campaign. The Sunday Island seemed the immediate pick. Its Editor Prabath Sahabandu has told ICP, his newspaper has no issue like other newspapers with this government, as they see eye to eye on the war.” The UN itself thinks the leak was orchestrated by the regime.

In another new development it seems going by the Trancurrents website the release of the Panel’s Report has been put on hold “pending discussions between Ban and External Affairs Minister, G.L. Peiris scheduled for April 23. According to sources the portal said the story is that G L Peiris wants to discuss an issue with Ban. G.L Peiris is also expected to persuade Ban not to publish the report and Ban on the other hand wants to publish the report in full whether the response is ready or not: “Pressure exerted by powerful western nations and International human rights agencies on Ban would ensure such release.

Sarah Smith reporting from New York for Channel Four News UK describes how the Rajapaksa regime orchestrated a sabotage of UN’s plans to release the report on 21st April, before the Easter weekend: The Sri Lankan government “knew they were about to be accused of war crimes and insisted that they be allowed to publish their response at the same time and they had so far refused to come up with that response so they have deftly managed to avoid having the report published and embarrass the UN at the same time.”

Sarah Smith alluded to the regime’s tactics of finding a good time to bury bad news: “They have had a copy of the report for nine days now. They have had time to leak substantial sections of it to the Sri Lankan newspapers. They have had time for the Foreign Minister to have a press conference denouncing the report’s conclusions and insisting that the UN don’t publish it. But at the same time not coming out with their official response, he has done that and stopped the UN from publishing it. And it means it is likely to come out over the Easter weekend getting a lot less attention than it would have otherwise. And it is a pretty clever way to find a good time to bury bad news to the Sri Lankan government.”

The so called “bad news” for the Rajapaksa regime being the Panel’s findings of “credible allegations” which “if proven, indicate war crimes and crimes against humanity were committed,” both by the Rajapaksa government and the LTTE.

While buying time, advancing its cause and using its persuasive powers and influence, as before amongst certain member countries in the UN at the expense of further sullying the reputation of this august body and its officials, the Rajapaksa regime is busy pursuing political and diplomatic maneuvers to try to scuttle due process. The regime though cornered is defiant as ever, denouncing the report and engaging in a multi-pronged strategy against the Panel’s findings at home and abroad:

At home it’s planning a massive May 1st Rally mobilizing the faithful to protest against the Panels findings of credible allegations. Although according to BBC a “Rift over Sri Lanka president’s call for anti-UN rally” has emerged. Trade unions affiliated to Sri Lanka’s ruling coalition are divided over the president’s call for mass protests against a UN report.

The Rajapaksa regime has also initiated a petition the Sunday Leader reported. A government minister C.B. Ratnayake involved in the project launched the public petition aimed at gathering a million signatures against the report at a private bus stand in Pettah.”

The Ground Views web portal was critical of the Rajapaksa regime’s efforts to whip up mass appeal: “This petition, and others that will invariably follow after the report’s official publication, is emblematic of Sri Lanka’s peculiar democracy, where highly emotive issues ratcheted up by expedient politicians with little or no grounding in actual fact are actually able to whip up mass appeal….. and support of Sri Lankans who know little or nothing of what they oppose, reflects the significant challenge of reconciliation and accountability, post-war.” Ground Views ncluded.

The Rajapaksa regime in its most crucial counter offensive to win diplomatic support against the report is ironically using the issue of reconciliation to argue against the publication of the report. Sri Lanka asked the United Nations on Thursday not to publish a forthcoming report on alleged war crimes… saying it could set back reconciliation efforts: “The publication of this report will cause irreparable damage to the reconciliation efforts of Sri Lanka. It will damage the UN system too,” Peiris told reporters in Colombo, stating This UN report is preposterous.” But most human rights defenders and journalist and legislators think truth, accountability and justice is most crucial for genuine reconciliation.

The Rajapaksa regime has dispatched its envoys to persuade all of its allies, especially those countries which supported Sri Lanka in the 2009 UN HRC resolution. The countries which voted for Sri Lanka’s motion were: Angola, Azerbaijan, Bahrain, Bangladesh, Bolivia, Brazil, Burkina Faso, Cameroon, China, Cuba, Djibouti, Egypt, Ghana, India, Indonesia, Jordan, Madagascar, Malaysia, Nicaragua, Nigeria, Pakistan, Philippines, Qatar, Russian Federation, Saudi Arabia, Senegal, South Africa, Uruguay and Zambia. Those who voted against were Bosnia and Herzegovina, Canada, Chile, France, Germany, Italy, Mexico, Netherlands, Slovakia, Slovenia, Switzerland United Kingdom of Great Britain and Northern Ireland and those abstaining were: Argentina, Gabon, Japan, Mauritius, Republic of Korea and Ukraine.

In Russia’s case according to Sri Lanka Daily Mirror, the Russian envoy in Colombo visited Gotabaya Rajapaksa and is supposed to have said the UN must not complicate the reconciliation process: “We speak not about a ‘UN report’, since it was prepared neither by a UN body or nor even by its request. It was just a personal initiative of the UN Secretary General”, the Sri Lanka defence ministry said quoting Russian ambassador in Colombo Vladimir P. Mikhaylov. Finally, the Ambassador concluded saying “we believe that now, when Sri Lanka is healing its wounds after long armed conflict, the UN may render its assistance, if needed, and not complicate the process of reconciliation. Our representative to the UN in New York recently reconfirmed this position.” It’s also interesting to note that Ban is visiting Russia himself and is seeking its support for his re-appointment for a second term.

Well known Tamil Analyst Ithaya Chandran explains the regimes strategy: Rajapaksa purposely leaked few pages of the report through the Island, in order to mobilize the Sinhala masses, religious leaders and politicians against UN. His first move began yesterday to obtain 10 LAKHS signature from Sinhalese to oppose the report. Gotabaya’s planned meeting with Russian Ambassador Valdimir P.Mikhaylov at the Defence Ministry was to get an undertaking from Russia. Gotabaya has declared that he has got the Russian and Chinese veto powers in hand. Through the leftist Minister, Vasudava Nanayakkaara, he is trying to get the support of left- oriented and anti-US countries, especially from the NON-Aligned movement. By manipulating the friction between Ranil Wickremasinghe and Sajith Premadasa, he would obtain the support of one faction of the UNP. By portraying the UN report as a ploy by western nations and by bringing all the left politics towards his authoritarian center, he plans to ultimately, deny access to any form of ‘concurrent international mechanism’ suggested by the UN trio.

Most Tamils are looking to India for its response to the Panel’s finding that tens of thousands of people were killed by government shelling which the Tamils think constituted a crime of genocide. Meenakshi Ganguli, South Asia director of Human Rights Watch, told PTI that “if India wanted to emerge as a leader on the global stage then the country’s leadership would have to show its intention of “protecting the rights of people over government.”

If calls for accountability grow, observers have noted that the Indian government would probably discuss the issue privately with the Rajapaksa regime. India’s position on human rights has come under increasing scrutiny as New Delhi hopes to get a permanent seat in the Security Council. Recently India, which is currently a non-permanent member on the Council, voted for the first round of sanctions against Muammar Gaddafi but it abstained on the resolution authorising use of force. “There are people in Tamil Nadu who also care about it (India’s position on the Lankan war crimes),” Ganguli said.

Although India is keeping silent on the leaked contents of the UN Panel’s report so far, it would be interesting to find out how it would react to the report. Recently Sonia Gandhi who was visiting the UK to deliver a Common Wealth Lecture on “Women as Agents of change” declining to comment on the war crimes issue but replied to concerns raised by Global Tamil Forum about the militarised north, crimes including rape of women committed by the military and the need for Tamil rights to be restored: “I am very, very concerned about the situation in Sri Lanka. Tamils should have their rights restored and it’s their rights you know. We are with the Tamils, you must know, we are with the Tamils.”

And just today April 22, 2011 Jayalalithaa herself “demanded that the government take ‘immediate steps’ to make Sri Lankan President Mahinda Rajapaksa stand trial for alleged war crimes during the conflict between the Lankan armed forces and the LTTE following a UN report.

Slamming her arch rival and DMK president M Karunanidhi for his ‘three-hour fast’ in 2009 demanding a halt to the Lankan government offensive, she said the UN report “clearly holds that the carnage lasted till May 2009, well after Karunanidhi had made his dubious claim that hostilities had ended following his fast on April 27.”

“The Indian Government, on its part, should initiate immediate steps to make Rajapaksa and his cronies stand trial in the International Court of Justice for his war crimes,” she said. Jayalalithaa’s statement before her anticipated victory in the Tamil Nadu legislative elections is timely and comes when a high profile statement was found wanting from the Indian sub continent.

While the release of the real, unmodified report in full is being awaited, there are a few measures recommended by the Panel which the Rajapaksa regime must seriously consider taking as an important step towards genuine reconciliation: Making a public and formal acknowledgment of its role and responsibility for extensive civilian casualties and institute a reparations programme. The question is will the Rajapaksa regime be prepared to do it?

    Rajapakse regime will once again whip up ultra-nationalism and anti-minority sentiments to organize protests in Colombo.

    Sri Lanka is not Libya.
    Nobody was allowed to report what happened during the conflict.

    The death numbers in the UN report is what is given by the regime which has a policy of ‘Zero casualty’ for outsiders and ‘Take no prisoners’ to the Sinhala military.

      Sri Lanka had a civil war for nearly 30 years. LTTE kept thousands of civilians as a human sealed. Same time they kept firing to SL forces by mixing with civilians. So on other alternatives for them other than retaliating for their shafty. Same things did by the LTTE too. Why these UN panel not talking about killing of many civilians by LTTE including children. Not any thing they are dancing according to the tune of Western countries such as USA, UK and France.

This is not about minorities or war which was in sri lanka this is about Ban ki moon re-election.Don’t just believe what CNN,BBC and $ hungry NGOs are saying.All should know that we are not like
      stupid like Iraq, Libiya or those middle easter countries. We know how democricy works.

        In Colombo there wasn’t any mass murder other than during black July in 83 when state terrorist used Sinhala thugs against minorities. Even at that time wester countries reacted strongly against state terrorist. We can live in peace in Sri Lanka. Before that we wanted war criminals to be eliminated to foster peace, humanity and civilisation in Sri LAnka

    It is a good thing if the human right situation in Sri Lanka can be improved by any means – I don’t know digging on the history is the best way but putting pressure to improve human rights is what is necessary.

    But the main question reamins at large is who has a right to do such a human right enquiry. Switzerland is one possible actor having no history of such big human right violations. But US and UK have been among the buggest human right violators in the history of the world!!! They are never being prosecuted for their crimes! Bush and Blaire invaded Iraq on false accusitions but no actions against the lost human lives against them! After world war two USA granted the top Japanese military officials top healthcare ranks in exchange of the findings of brutal experiments on Chinese! These included bio weapon testing on human. They cut open life humans! US did infamous guatemala STD experiment. Recently they apologized for that but they did not prosecute the culprits!!

    Now can these human right violators point fingure at Sri Lanka, which did all it can to finsih a war that have been causing so many human deaths? They had experienced over 70,000 deaths due to the war before 2008. After the final phase of war where 40,000 more died, no more such deaths! Can US justify any of their political wars that took thousands of civilian lives as a way of saving lives? Can British avoid the blame of introducing comnflicts in many of its colonies? Isn’t west guilty of feeding LTTE to carry out so many deaths?

    Let a country free of such dirty baggage prosecute human right violators of Sri Lanka. Obviously that is not US, UK or those in EU.

    As the Russians stated, this so called UN Report is not sanctioned by UN members but a personal advisory request from Ban Ki- moon. This outrageous attempt to harm the ethnic reconciliation process underway in Sri Lanka will create bitterness and division among the communities. All the fact finding this panel did was from Tamil diaspora who financed LTTE and the die-hard supporters of LTTE. What do you expect to find ? The mistake the democratically elected Sri Lankan government did was not to allow this panel to visit Sri Lanka and talk to the people who were caught in the middle to find the truth. Government thought this UN panel will destabilise their own Truth and Reconciliation Commission, therefore they refused to cooperate.

    Let us analyse why UN is doing this.
    Prior to the ending of war, internationally banned terrorist outfit LTTE has been running a virtual government in Nnorth and East of the country forcefully taking away the children and training them as suicide bombers ,the concept they invented that other terrorists follow at present. This war has been going on for three decades where LTTE violated the rights of people ruling by the gun financially supported by Tamil diaspora overseas.

    During the final phase of the war in which Sri Lankan forces eliminated the LTTE and rescued hundred of thousands of civilians held captive as a human shield, USA, UK and Norway governments requested SL government to stop the war and offered safe passage to airlift 100 odd top leaders of LTTE and their families. USA did not want SL to be the first country to defeat terrorism when they were in a mess to control Iraq and Afghanistan. Also as per Wiki-leaks the Tamil diaspora virtually blackmailed western politicians for votes if they did not support LTTE. LTTE has smuggled the Tamil diasporas and smartly settled them in certain electorates to get the numbers significant enough have a say.

    Sri Lankan leaders stubbornly asked the West to go to hell. Wiki-leaks confirm what was said to David Milliband and the French FM in Colombo. This is why these countries have a vendetta against Sri Lanka for revenge. They were the colonial masters after all. Now most of the UN funding comes from these western countries especially USA. It is not rocket science to understand UN is a puppet of the western world. UN sanctions, the invasion of countries western powers don’t like / vested interest in resources are paving way to massive human right violation of civilians caught in the middle.

    Ban Ki-moon is near the end of his term in office and is due for re-election. No secretary general is appointed without the blessing of the major funding nations. Who is Mr Ban trying to please now? Sri Lankan nation or his masters who can reappoint him? Ban Ki Moon and his UN does not care a donkey about what the truth is but only their own interests. I wonder what the UN has to say regarding the Iraq indiscriminate bombing (shock and awe tactics), Guantanamo Bay enquiry in US and Iraq enquiry in UK that were swept under the carpet by the respective governments.

    It’s sad to see that the UN has once again fallen prey to the Western financial culpability/domination and their vested interest! Is that the mandate of the UN? Will the UN HR Council intervene if the US, France or UK breaks into civil war and when the State/Govt. uses its army /military forces to repeal domestic violence [terrorist]. Or is the word “terrorist” inter changeable to suit the UN HR Council and its vested alliance.

    Why did the UN not intervene in US, UK or France? Or when US African community where persecuted by the white American government backed cults/clans [http://www.counterpunch.org/stephens05132005.html ]? Or has the UN HR Council forgotten Ireland’s civil war and its leaders? Or more recently, when Bush, Dickcheny were found fabricating WMD’s in order to gain access to natural resources, at the expense of many thousand Iraqi lives [see wikileaks/John Perkins http://www.johnperkins.org/ also see http://www.counterpunch.org/stephens05132005.html%5D ?? Why is there no probe into the Abu Gharib torture chambers? Why not investigate the Goldstone report? Is this something beyond the scope of UN HR Council when blood is shed with UN impunity and approval? Where is justice and the needed closure to the many families who have suffered by such atrocities at the hands of UK, US and UN/France, what happened “Justice/Democracy to the World at large and their pain”/Investigation into Human Rights ??

    The idea of ‘International Justice’, ‘Universal Right to Human Rights’ and ‘Human Equality’ is now none existent in the UN charter, it’s a shame to see the UN/US/UK/EU display its duplicity. The instigators subtle hand is evident to all of the Developing World and to all those who see its immorality in their line of work and destabilizing in their approach to opponents of ‘US/UK is Best Ideology’. This inaction by the UN HR council and the many lapses of investigation into its own Security Council Members is glaring and shameful to all righteous men. The UN is not worthy of serious thought and its ad hoc work is mere waste of Western Tax Payers Funds. Clearly what this report says it’s good to kill one ethnic group [the Sinhalese, Muslims, Moors and Burghers] who DO NOT seek favor with the West. Or put differently the UN HR Council supports those who sell their motherland to gain political asylum/social welfare from the West/Political patronage. It has been proved beyond reasonable doubt [see wikieleaks/John Perkins] that the same US/UN diplomats who talk about “War Crimes” and “Human Rights” obtain financial support for their own political campaigns/office, with social welfare monies been provided by the so called “domestic tax base” [see Political Corruption in America: an encyclopedia of scandals, power, and greed By Mark Grossman].

    What needs to be understood, is that in any civil conflict there is no one side that is right/wrong, nor can any side hold moral right to inflict death and destruction on another group for want of reason. In that case will the UN HR Council hold LTTE financiers and their sympathizer accountable? Will the UN bring the LTTE to book and also hand out equal punishment to those Sri Lankan’s [Tamils] who funded, colluded with the LTTE -Terrorist Org so deemed by US/UK/EU states, to commit many atrocities and destruction home and abroad? Aren’t they too found to be ‘Mens rea’ or to be held as accessory to mass murder?

    Sri Lanka does not need advice from outsiders. Therefore, let the people of Sri Lanka [all ethnic groups on the ground, who have suffered through a life time of 30 years because of the war, mentally and physically] deal with healing and reconciliation process in manner that will be right by all communities that have been affected. Both parties have had their fare share of death, loss of assets and loss of appreciation for life. Let the people who lived through this on the ground, therefore, deal with the wounds and find a path to mutual self respect, shared reconciliation and dignified co-habitation. The UN can keep its “So called” report in a place where it so chooses it belongs. As it does not belong to the People of SRI LANKA!

      Don’t blame the West for supporting the Tamil terrorists. Have you not heard of the large sums of donations made by certain Tamil organizations to “Certain” politicians during the 2008 Presidential elections? So there’s a “Certain” obligation obviously! You scratch my thing, and I’ll scratch yours!

    Its pathetic but has been notable that most of the EU and US were not happy that smaal Sri Lanka defeated a three decades of war against the world’s no.01 ruthless Tamil Terrorist Organization which is LTTE. The need to destablizing Sri lanka remains in the cards.

    LTTE during the past amassed huge amounts of money which they used for purchase of weaponary(including aircraft, submarines and what not!), propaganda, and their logistics. They have been also enjoying the complete blessings of disguised peace brokers supporting their cause.They have been getting powerful western figures supporting their claims and they even managed to get their people elected in foreign political arena supporting them.
    Now the hard earnt peace by Sri Lanka is looked at with hatred by others who cry thet they are against terrorism. The lives by hundreds and thousands are deprived of poor nations in Iraq, Afgan,Palastine,.. These are justified?? UN has been blind concurring these acts. When LTTE killed, tortured unarmed innocent people in Sri Lanka including Sinhala Tamil and Muslim UN did not seem wrong .When LTTErs cut/hack open the pregnant ladies throwing the babies yet to be born, these voices were silent.Babaric killings in Sri Lanka are over and PEOPLE NEED PEACE.Does the UN and others want to reverse th process? How much blood has been shed whether its Sinhala/Tamil or Muslim, on SL soils. Sri Lanka will get the right peoples’to defeat the foul hidden aggenda against it.

      Winston. Are you forgetting that an end to a war in a third world nation is an end to their military hardware sale to ALL warring factions of that conflict. As long as the war with the Tamil terrorists continued, these same nations would never have made such a noise as they do now, even if there was genocide as in Israel, Afghanistan and Iraq – and previously in Chile. As long as their war machinery sales were going well, they would have kept silent – whether genocide or massacres. Moreover, the mere fact that Sri Lanka, a small third world nation, was able to finally take on the world’s most barbaric and ruthless terrorists organization – the Tamil Tigers – and defeat them and wipe them out completely from its face, has created a severe embarrassment to these Western nations that are trying for so long to fight a terrorist war of their own without any success whatsoever.

      The International Community, UK, US and EU were not known the inner motive and dirty mentality of the criminal minded, Aparthied Sinhala Buddhist Rajapaske regime.

      This regime has been denying access to Tamil areas and gather truthful information to those who supported the war including the UN as it has committed mass murders, rapes, tortures, burned people alive, disappaereneces of innocent people, attacking and intimidating the media and journalists including the murder of Lasantha Wicremathunga.

      Even during the war this brutal regime was intimidating the diplomats, international community, UN and its staff, murder of 17 French Charity workers, cold blooded killing of Tamil MPs and school boys and human rights activists.

      It is sad that those who live in the West and enjoy Western values are writing comments in support of the alleged war criminal regime and deny and obstruct the international cmmunity to deliver justice to the victims! These people do not deserve to live in the Western world!

    I am a Tamilian from Jafna. During the last phase of war I could not stay there due to our own LTTE bros. I had to pay a ransom of SLRS half a million that we had all for four of us, surrendered that to our own LTTE bros & escaped. If not today we r not here. My cousin bro who could not escape, rang me just 2 days before the final D day & said if he is lucky he will cross to SL Govt Controled areas & he told me that he did not have food & proper drinking water for weeks & further LTTE is shooting we tamils if we try to cross to Govt control areas. When I explained him that in the SL Govt TV they saw so many people escaped & came to govtt control areas he said they r really lucky but he saw to his own eyes our Tamil LTTE bros are shooting & our own Tammils. Further he said if he realised this is is the final ultimatum of LTTE & their mentality to kill our own raise he would never decide to stay there. Since that call I did not see him or jear anything & I am sure he must have killed by LTTE. So inconclusion the panel that UN has setup is just a uselessone. UNO pissoff. UNO u are late & purposely late.

      Every citizen must expect the state to provide security, mainatin Law and Order, have impartial Courts to deliver fair justice and so on like in the Western countries.

      Due to the failure of the successive Sinhala racist Apartheid regimes, LTTE was created and it is no longer in force.

      Even after ending the war, the Rajapske regime is continued with emergency Laws, detained over 300,000 innocent Tamils in detention camps, abducted, raped, tortured and murderd hundreds of thousands of innocent Tamils.

      Why the governmnet deny access to investigate war crimes and human rights abuses if they have not committed the same?

      Why this government continued on terror on the Tamils and noever prosecuted any one to date for the crimes?

      what about the people who simply disappeared?

      What about the war crimes videos that surfaced, thanks to the Sinhala who sold it for money?

    Here goes another so called world human saviours. This man is talking about SLG manipulating UN and he has not mentioned a single word about how US and UK manipulating UN and the whole world. Who is responsible for the millions of Vietnamese and Cambodians killed by US? Who is reponsible for over 300,000 innocent civilian deaths in IRaq by the US/UK operations, who is responsible for the tens of thousands deaths in Afghanistan? What about the innocent civilians killed by the so called friendly fires in Libya? Has there been ever any inquiry to those? Why don’t you fight for it if you are so concerned about human lives.

    Come on man get a life and fight for the justice for those people killed by the US and UK. Why are you scared to talk about it. Aren’t you intelligent enough to understand that what UK and US wants is to divert the world attention from all inhumane things they are doing in Afghanistan, Iraq and Libya. Don’t you have a brain to know that they are not happy with Sri Lanka for not listening to them and to stop wiping out the most ruthless terrorist group in the world?

    Can you name one single war that has never killed a single innocent civilian? You must be knowing that to write rubbish like this.

    Come to Sri Lanka and see for yourself what really is happening now. People in the north are free and can go about their lives without being worried about getting killed if you stay at home or walk out the house. They don’t have to worry about their children been taken away by the LTTE. They know now children and adults goes to work in the morning will return home at night. They can sleep well. Why don’t you investigate and write about the current lives of the Tamil people and whole of Sri Lankan people and compare it to then and now. DO something useful.     The 30 year civil war in sri-lanka is a brutal war unleashed on the people of sri-lanka by an illegal terrorist extremist entity called the LTTE terrorists who killed thousands of civilians in sri-lanka including sinhala, tamil and muslim civilians and members of the srilankan armed forces.

    It is quite interesting that 30 years of brutality was unleashed on the sinhalese, tamils and muslims of sri-lanka by the LTTE but not even thousands of incidences of child soldier conscription is covered by this bogus UN report. It does not cover the ethnic cleansing carried out by the LTTE terrorists either. The UN report doesnt even look into the thousands of bombings against civilians, or even the killing of a prime minister of india, a president of sri-lanka, many ministers, MPs and tamil intellectuals. Nor does it have anything to say regarding the massive amount of weapons and arsennel of the LTTE terrorists found at the end of the war, enough to blow the whole of sri-lanka up three times over.

    However it does cover the final days of a war unleashed by the LTTE on the rest of sri-lanka which has lasted thirty years. No explanation is given as to how the final days of a war is somehow more important that the preceeding 30 years.

    The report of full of concocted up lies and innuendo and it is clear even to a ten year old that most of it is innuendo and wholesale made up lies.

    It is obvious that the UN today is a catspaw of the west in particular the US, EU and the UK and is being used to further their nefarious agendas at the expense of especially weak poor nations especially those with massive oil resources such as the actions in iraq, afghanistan and libya shows. We are shocked and awed when we see the cluster bombs, cruise missiles and the ‘shock and awe’ tactics used in places like iraq. It really is shocking and sometimes mindboggling. The double standards of bomb first talk later attitude of the US, EU,UK is also quite shocking.

    The rajapakse regime has committed unspeakable crimes against humanity and human rights abuses against Tamils.

    Rajapakse regime has defied the international norms and Law in attacking innocent Tamils including women and children, committed torture, rape, abduction, disappearences and mass murder.

    No civilized person can tolerate this kind of barbaric behaviour by denying access to international diplomats, media, journalists, human rights groups and other humanitarian organizations.

    Comments of the Sinhala is clearly show the denial of justice to the victims and that the Sinhala is not interested in reconciliation or truth finding but cover up criminal activities and continue to destroy Tamils in Sri Lanka.

    Rajapakse is always a Sinhala nationalistic and those who supported in the past will know his real side of the story that he is a mass murderer and committed ethnic cleansing.

    It is impossible to reconcile both Tamils and the Sinhalese due to several decades of ugly crimes committed against the Tamils.     This a lesson to UN as it has failed to prevent a human catrostophe.

    It should not be carried away by the propaganda by few politicians who court some powerful world leaders and then let loose mayhem and serious human rights violations.

    We have clearly seen how town after town was destroyed by Sri Lanakan military which starved the tamil people to submission. What is shocking is the summary executions of Tamils fighting for freedom.

    It may be LTTE or PLOTE or any donkey. But what is important is this fighters have been pushed by the shinalese politics of hatred and they where pushed to take up arms.

    If the Sri Lankan government was genuine in its heart to find a lasting solution it would have worked out peaceful deals with the LTTE captured fighters by showing them the light as taught by Buddha.

    But unfortunately the Sri Lankan government took the bandit route and tried to eliminate people who where opposed to its views. UN should bring Rajapaksae and other leaders to the world court.

    The International Community should send a strong message to other leaders that noone will tolerate human righst abuses and war crimes.

    Shame on those nations that supported the Sri Lankan regime without knowing their Apartheid criminal mentality and thus their hands too soaked with innocent Tamil blood.

    Further it was sickening to analyse today that noone has came to the rescue of the innocent Tamils when they were kept in detention camps, bombed indiscreminately including hospitals and schools, raped, tortured and mass murders took place after the end of the war.

    Where was the UN and the so called Western nations who rushed to help the Libyans when few Libyans were killed but allowed the Sri Lankan regime to commit crimes against humanity unabated against the Tamils?

    There were no justice delivered to day for the innocent Tamil victims and Rajapakse and his crinies must be brought to justice. There will never be reconciliation in Sri Lanka as both the UNP and the SLFP major parties always used the chavunitic approach to politics and involved in State terrorism rather than respecting minority rights.

    History will remember that Rajapakse as the Pol Pot of Sri Lanka!

    Also credibility of the UN is already tarnished due to its failure to prevent human tragedy!

    Tamils all over the world should appreciate what happy changes have brought to the Sri Lankan northern Tamil people. It is still not perfect but then again which country is the perfect place to live. If any idiot thinks that after nearly 30 years of murder, torture, kidnapping, fear and extortion by the LTTE within 3 years everything will be perfect they need to get their heads checked for stupidity level.

    After 20 odd years of civil war in Ireland the country has gone to recession and bankruptcy, whereas whole of Sri Lanka is improving daily. There are still minor issues.

    I would like to ask from all those concerned people of Tamil people how much they have contributed to help and improve the lives of the Tamil people of the North? This is the time for those to take steps to help them. The same people who contributed monthly to LTTE to buy and kill humans, should now give that money to all those affected by the LTTE including Sinhalese, Muslims and Burghers. There are many thousands of innocent children, women and young old people who are still suffering from various injuries sustained due to LTTE indiscriminate bombings and shooting.

    Stop talking and now is the time to prove that you care about all inhumans especially the long suffering Tamil people of the North.LTTE sympathisers should pay compensations to those people affected by the LTTE ruthlessness.

      It is sad that there are still people like you who can lie like that. Where do you honestly believe 50% of the Sri Lankan Tamils live? Who do they do business and who are they working with? How many Tamil government ministers are there in the SL Govt? How many Tamil bosses are there in the government departments and private companies?

      My own doctor and the dentist for the last 20 years are Jaffna Tamils. Our family friends are Tamils. Who is the majority in Colombo? Which area of Sri Lanka can you tell that there are no Tamils. But I can tell areas where there are no Sinhalese because LTTE terrorists manage to kill most of them and the rest chased out. How many Tamil people you know that has been killed by Sinhalese people because of their Tamil race except during 1958 and 1982 by some idiots like JVP. Do you know who protected most the Tamils during those riots?

      People like you wants nothing but to create hatred among the races and then among yourselves.

      Do us all a favour especially Tamil people of Sri Lanka and start to respect everyone as Sri Lankans and not as Sinhalese, Tamils, Muslims, Burghers etc. You will have more peace in your mind and you will start to enjoy life as it should be.     ASIAN TRIBUNE has published an Interview with Mr T.RAJASINGHA, ex-mp of TNA and who lived with people herded by LTTE and he reveals how innocent civilians were butchered by so-called Tamil saviour LTTE! He explains how Sri Lankan forces rescued, treated these people. His is a first hand information because he lived until the end of crisis with people. He says Pulithevan, Nadesan were shot at by LTTE! Prabakaran never wanted them to survive!

    It is not President Rajapakse who manipulated anything but its pro-LTTE elements, UN, INGOs and Western media who were misinformed by the LTTE and Pro-LTTE elements.
    How stupid that these people who has exagerated the death toll to 40,000 or even more dont know that the following facts:
    (1) It is LTTE and not SL Army who killed thousands of Tamils who tried to flee LTTE cluthces.
    (2) It is LTTE terrorists who wore civilian clothes and fought with Army and got killed.
    (3) It is LTTE who used untrained civilians with weapons and sent to the war front and they of course got killed by SL Army because they were terrorist fighters even though they were civilians.
    (4)It is LTTE who used civilians as a human shiled.

    NOW YOU MORONS should add these deaths and of course it may add up to thousands of tens of thousands…How the hell UN or INGO or f…..LTTE tell the world that all these people are innocent Tamil civilians????

    In fact, it is SL Army , Navy and Airforce who rescued fleeing Tamils, fed them and given shelter.

    These pro-LTTE Tamil and foregin elements should commit suicide or …..get lost!

      Sri Lanka war criminals have ended up in Western countries sent by the Rajapakse regime, continue to be engaged in propaganda for this war criminal regime.

      LTE is a product of Sinhala state terrorism and hooliganism and not a product of the ordinary Tamils.

      War criminals should be brought to justice and I see most Sinhalese’ writings in support of alleged war criminal regime! What does it show!

      Those most Sinhalese are Apartheid minded and they are against the minority Tamils.

      Alleged war criminal Dr. Palitha Kohona has recently said at the Syracuse Maxwell School seminar that the Sinhalese are a majority with a minority complex. They have to get treatment for this and not to rape, attack, rob and kill Tamils!

      See the panick situation in Colombo and the brutal regime is requesting not to publish the UN report that was written by experts on war crimes and human rights abuses.

      India is in a difficult situation as the Congress get defeated in Tamil Nadu that will change the politics completely.

      You may remember the days that Indian Air Force flights over Jaffna and IPKF was in North and East of Sri Lanka.

    UN and US should have taken a firm action like in Libya or Serbia to bring the alleged war criminal regime leader and cronies to justice.

    There will be full scale war crimes and Human rights investigation against crimes against humanity and thanks for the Sinhala who sold videos of war crimes committed by the armed forces and ready to provide witness against the Regime leaders.

    Committing murder, rape and torture is a BARBARIC ACT and not a brave act.

    Most Sinhalese writings are against the International community, UN, Human rights groups, Tamils and those who are democratic and demand for justice.

    Tamils have suffered enough at the hands of the Rajapakse regime as well as previously since independence.

    Sinhala criminals are worried about the war crimes trial as they have committed crimes against humanity. Tamil Diaspora is planning well to work with the International community to deliver justice to the victims.

    Hundreds of thousands of people have been detained, raped, tortured and murdered after the end of the war. No civilized person on earth can tolerate this barbaric act and no criminal must escape from taking responsibility.

    I doubt that the Tamils and the Sinhala can live together in years to come athough several Tamils have married to the Sinhala and I see cracks in their family life overseas.

    Successive Sinhala leaders have failed to apply rule of law equally to all, failed to maintain law and order and deliver impartial justice for all.

    UNP and the ordinary Sinhalese if geneuine, should support for an International investigation on human rights and war crimes as the regime was alleged to have committed mass murders and other crimes against humanity.

    India is in a difficult position at present and Sinhalese should not forget the IPKF days in Sri Lanka. India will always want to make Sri Lanka depending on them and destroy prospertity. Is this the Sinhala people want that IPKF in Tamil areas?

    What a foolish Sinhala society that made Tamils very strong and prosper overseas and the Tamil Diaspora is gaining strength day by day economically and politically that will lead to find a solution to the local Tamils that Sinhalese never expected or wanted. They are working with the Western leaders, expose Sinhala regimes’ barbarian and criminal activities to the world and this will lead to a permanent solution to the Tamils in Eelam.

    Do the Sinhala want the Tamils in Eelam to be part of India?

    Even after two years of ending the war, emergency rules are still in force, abductions, rape and murder are going on unabated by the Sinhala forces.

    Do the Sinhala believe that the world will idle by witnessing all these cruel crimes?

    Tamil terror-sympathizers have infiltrated politics all over the world. Greedy, power-hungry Western politicians having accepted their promised votes and “Campaign Money” (a.k.a. Terror-money), are playing to their tune, taking a campaign against Sri Lanka, fueled solely by the anger by the Sri Lankan Govt., who did not bow down to their demands during the end of the brutal war. And, Banki Moon dances to the song of his Western masters. Little do these short-sighted politicians know that these actions will lead their country to a very uncertain future: case-in-instance, LTTE-terror-supporters who teamed up with a certain Canadian politician, recently accused him of racism and discrimination, in a well-publicized manner. This, just because of a disagreement between them on Sri Lanka. There has been a “Transnational Tamil Eelam Foundation” formed in Canada. Pretty soon, there will be separatist demands around the world, such as already seen in France and Canada. The West has done too little, relying on their supremacy and intimidation of poorer countries with their money, and pay no attention to the Greater Asia region of China/Russia/India. It may be too late for the West.

    I’m a Sinhalese Buddhist, and i do not agree what has happened to innocent Tamil people during and after the war, there is a substantial section of the Sinhalese population do not agree with this and patiently waiting for the justice to happen for both sides, as you probably know, it was Tamil people earlier now it is Sinhalese turn, whoever opposes this regime will be labeled as LTTE sympathizes or traitors and will have to face the consequences.
    My question is , was not that LTTE who helped MR to come to power in 2005 , and why ?

On the CONTRARY THE BEST FORCES IN THE WORLD and that too with a COALITION of many COUNTRIES with the WORLDS BEST ARMOURY eg.     Sri Lankan war crimes must be prosecuted

    The Government of Sri Lanka is contesting a report by the United Nations which reveals that tens of thousands of civilians died in its final offensive to end the country’s civil war two years ago. Most of them were killed by government shelling which targeted hospitals and UN and Red Cross centres, a UN panel of experts has found. The acts were war crimes, the report says. It is not a one-sided document. It also says that the Tamil Tiger rebels used 330,000 civilians as human shields, and shot those who tried to escape. But both sides contest its findings. The government insists it can prove it never targeted civilians.

    The rebels claim that the last-minute truce the government offered was not long enough to allow civilians to safely leave the conflict zone.

    There is a simple way to resolve this. The international authorities should lay charges against both sides, before an international war crimes tribunal, to answer what the UN calls “credible allegations”.

    UN Secretary General of having setting up the three-member panel that spent 10 months gathering evidence – without the help of the government in Colombo, which refused to allow the investigators into Sri Lanka. Indeed the government pressed the UN not to publish the report, claiming it would damage reconciliation efforts.

    There are allegations against both sides and a proper hearing of them would lead to the kind of purgation which is the precursor of political healing. Last year the Sri Lankan government appointed its own commission to look back at the war. But human rights groups and Tamils have rightly expressed scepticism about the independence of the commission.

    The UN is to carry out a review of its own actions in a conflict during which, the report says, it did not make public the high casualty figures it was receiving. That might have put more pressure on Colombo to exercise restraint. Yet if the authorities in Colombo are certain of their innocence they should have nothing to fear from answering these allegations at the bar of an international court.

    “The Sri Lankan government’s immediate dismissal of the report as biased demonstrates that there is no chance of a serious domestic justice process,” Brad Adams, Asia director of New York-based Human Rights Watch.
    “The only hope for victims of the conflict is an international investigation leading to prosecutions.”

    This regime has certainly tarnished the image on Buddhism and the Sinhala as it forcefully shut the voice of the moderate and progressive Sinhala.
